Court Limits Abortion Subpoenas But Affirms Grand Juries
|
A court ruling on abortion-record subpoenas in Kansas offers something for both sides of the dispute.
The Kansas Supreme Court has ruled that grand juries imposed by citizen petitions are constitutional. The court refused to strike down a subpoena from a grand jury investigating Wichita abortion provider Dr George Tiller. But justices did allow Tiller's office to make copies and strike information that might identify patients.
But, the justices sent back to the District Court the question of whether that subpoena is overly broad or intended to harass Tiller, as was claimed by his lawyers. |
