Men Face Death Penalty For Race-Based Killing

Two Kansas City men have been convicted under a federal civil rights statute for a racially-based murder.
A US District Court jury found 21-year-old Gary Eye and 22-year-old Steven Sandstrom guilty of numerous counts stemming from the murder of William McCay on the streets of Kansas City in March of 2005.
The penalty phase of the trial starts on Monday. Each man faces life without parole or the death penalty on the worst of the charges.
Prosecutors say Eye and Sandstrom tried to shoot McCay as he walked down the street, but missed. Evidence presented at trial indicated that they went around the block, found McCay, still walking at 9th and Brighton, and fatally shot him. The capital charges stem from that second shooting.
